HALAL FEES EXPOSED IN COURT JUDGMENT

... who exactly gets a slice of the halal kebab market

I want to make it clear that I would never endorse, condone, or encourage the use of someone else’s trademark. That is an unlawful activity and is punishable by court order.

What interests me from disclosed documents from the Federal Court of Australia is that they show just how substantial halal certification fees are and that there is disagreement among Muslims about what does and does not require certification.

It also highlights the giant pyramid-style scheme of halal certification in this country.

Two small retail outlets were taken to court for unknowingly displaying halal certification documents that had been falsified. The court documents show that had these two small kebab retail outlets paid for the halal certification it would have cost them $5000 each per year.

That is quite an overhead for a small business to have to absorb in this economic climate.

It is also noted that they believed the meat supplied to them from “Quality Kebabs” was halal certified so they didn’t think it was necessary for them to have to pay for “certification” as well.

The court document goes on to say:

“Quality Kebabs has obtained the benefit of operating its business on the basis that it has been certified by the applicant when, in fact, it has not. There are no great difficulties in assessing the expense Quality Kebabs has avoided having to pay by falsely asserting it was certified by the applicant. Mr El-Mouelhy’s documentary evidence was that his fee (without GST) to wholesalers was $27,090 in 2012, $33,580 in 2013 and $34,510 in 2014. I accept that Mr El-Mouelhy’s prices are likely to be at the upper end of the market (he is, after all, a Rolls-Royce and not a Mini) but it was Mr Kose who chose to steal a Rolls-Royce.”

So the two small retail outlets were charged just nominal damages of $10.00

But note this; “Quality Kebabs” had to pay what was equivalent to the 2012 fee of  $27,090.00 plus a 50% uplift which equates to $13,545.00. On top of that they had to pay the 2013 halal certification fee of $33,580.00, plus 50% uplift, which equals $16,790.00!

That makes a total of $91,015.00. Now that doesn’t include what “Quality Kebabs” would have had to pay for 2014 which would have been $34,510.

What these court documents don’t address (because they don’t need to) is the fact that for “Quality Kebabs” to be halal certified they would have to source their meat or chicken from a halal certified abattoir or chicken processor, in this case Steggles.

We know some abattoirs pay up to $27,000 a month to be halal certified. That is $324,000 a year. We have also seen a receipt where one chicken processor is paying $40,000 per year!

I have reported previously on a driver who drove a chicken supply van from a chicken processor to the take-away shops and he was charged $500 in halal certification fees. He also had to back-pay fines to the imam when he failed to get certification for a few years.

This is one example of the giant pyramid scheme going on within the Australian halal certification industry. So you can have an abattoir spending $324,000 in halal fees. Then the transport company is paying hundreds to drive the product to the supplier. In this case the supplier has to pay $34,510 in halal fees. Then the transporter may again have to pay a few hundred dollars to a halal certifier. Finally the little retail outlet has to pay $5000 in halal certification fees.

This totals in excess of $364,000 paid in halal fees, just on a small part of the kebab market!

Is this all absorbed by each company and NOT passed on to the consumer? I seriously doubt that!

So the next time you hook in to a kebab, sit back and think about how you have just lined the pockets of halal certified agents along the way.

The person in this court case (Mr El-Mouelhy) has been quoted on national television as saying the profits have made him a millionaire and he is in it, “to buy his wife’s shoes!”

So who are the bullies?

Are they Australian consumers who have had enough of paying for an Islamic religious rituals imposed on their fast food and grocery products, or are they the halal certifiers making a motza out of the unregulated and highly debated practice of charging fees for halal certification?

Kirralie, I support your efforts entirely, but what I want to know is how do we get rid of halal with it's cruel and sinister overtones, and the ugly sheik halal el Mouelhy for ever.

I have been using the iPhone app for all our grocery shopping since downloading it and I am amazed at the number of halal certified products. Only today I came across a tin of Spam that was certified, now if that doesn't show the scam for what it is nothing will. I can't remember the brand name on the tin.

Kirralie, thank you for the link. I have read it in full. Twice. Your implication is somewhere between flawed and wrong. How can I put this... the applicant and the assorted defending parties - appear - to use the term loosely - to share a regional tendency characterised by placing integrity below personal interest. To position the ruling of the Hon Nye Parram as evidence that the applicant's case was entirely without merit was incorrect.

I am, I must emphasise, satisfied that there is a sinister element of halal certification but this case does not further your cause.

Excuse me Kirrallie would you or any know here if Lions Xmas cakes and Pudding are or were `H` certified..? Or which company makes the foods?I searched but can not seem to find out.It states they are Secular indicating they would not be `H` but I would appreciate knowing.. if any might help?

I wrote to my local member and his reply basically said that halal certification was a good thing that helped industry and was good for the Australian economy. He went on to say that if I thought halal funds were being used to support terrorism I should contact the AFP - you know the ones; they are the dumbos that stood around like dorks while six budding terrorists got out of Australia last week to go and join ISIS .

Kirralie, I just heard on Radio National a very biased report on Halal, including a call for a tightening of Social Media laws to prevent our movement against the Halal scam. The ABC really are very seriously left-leaning. Seem determined to change the Australian culture. The call for tightening of Social Media laws is of great concern, as it is our only avenue to voice our legitimate concerns regarding the way we are treated by Gov. and others. The next election will be the first time I seriously consider moving from a philosophical position to that of ensuring that the government I vote for will be forced to address the unacceptable situation that we currently endure. You may be aware that " Dick Smith " chain franchise stores are being pressured by the Islamic Council of Australia to gain 'Halal Certification' otherwise they will be proscribed and banned from Muslim custom.

This is their response:

"We at Dick Smith 's have received a number of letters from people asking if we will be putting the Muslim Halal logo on our food.
To acquire Halal certification, payment is required to the endorsing body (the Islamic Council) and involves a number of site inspections of both our growers and processors in order to ensure that our practices comply with the conditions of Halal certification.
It is important to note that this does not reflect the quality of the food being processed or sold – it only means that the products are approved as being prepared in accordance with the traditions of the Muslim faith.
We are aware of an increasing number of large companies both in Australia and overseas, such as Kraft and Cadbury, who have obtained accreditation to use the Halal logo. We don’t believe they have done this because of any religious commitment but rather for purely commercial reasons. Perhaps these large organisations
can afford to do this.

How less Australian can companies get, than to place money into the hands of those who seek to exploit us?"
This is an example of how the leaders of Muslims in Aus/NZ are bullying large commercial organisations (especially in the food industry) into paying what is no more than blatant extortion money. The amazing part is that these weak-kneed organisations (Cadbury/ Schweppes/ Nestles/ Kraft etc.) actually pay the large
sums demanded by these self-appointed religious bureaucrats. Of course, the manufacturers promptly pass this levy on to unwitting consumers as cost increases. Next time you buy a block of Cadbury's chocolate, look for the Halal Certification seal on the wrapper. So, regardless of your own religious faith, you end up subsidising Islam.
The Council also controls the Muslim voter bloc which, as yet, does not have sufficient critical mass to make a difference - but give them time.
Several state jurisdictions are under pressure to adopt or permit Sharia Law in Marriage, Family and Property matters and some, under the delusion that they are being progressively liberal, are permitting this. This has already happened in some local authorities in the U.K.
Google the U.K. Education Department's current investigation into the conduct of Muslim-run schools in the Birmingham area of England .

HALAL ONLY SHELVES! Packaging clearly marked as such in easily legible letters of a stipulated size and sold from their own section in supermarkets. This will make it easy for those who wish to purchase such products to locate with a minimum of fuss. Fines for producers and stockists for false, misleading and/or incorrect labelling of their products. Halal certifiers should be required to pay food producers a levy for going to the extra cost to produce such products. Unless of course they want to provide the service for no charge. A good idea is to market t-shirts showing the halal signs. I don,t know what they look like and I shop at IGA, in WA. The shirts don,t need to have negative words, just, "have you checked for the halal signs? ". Could be helpful for our Muslim shoppers you see. They wouldn,t want to handle anything not halal,

Maybe we need to support politians who are prepared to stand up to Islamics .. like Jackie Lambie rather than pillory them for being imperfect politians..

I would suggest that one of the reasons that Halal is gaining strength in this nation is that Halal is invisible to the uninformed public. Four years ago, I, along with many others had never heard of the word. Now, Halal is in my face. Halal is now undoubtedly the most insidious form of control over a nations food supply to ever be allowed into our society. Islam is about mass control, Halal is a means of financing Islam, radical or otherwise. Halal is outright extortion, blackmail and control by a minority over the majority. Halal is against the Judaeo-Christian society in which we live.Therefore, it is time for the Australian public to demand a national referendum for or against Sharia Law and Halal certification in this nation.
